Terms & Conditions

1. Introduction

These Terms and Conditions govern your use of the Deals4Africa online auction platform and your participation in any auction we conduct. By registering an account or placing a bid, you agree to be bound by these terms. If you do not agree, please do not use the platform or bid.

2. Registration & eligibility

You must be at least 18 years old and provide accurate registration information. Accounts are subject to verification before bidding is enabled. You are responsible for keeping your login details secure and for all activity on your account.

3. Bidding

Every bid you place is a binding, irrevocable offer to buy the lot at the bid amount. Bids are placed in the increments shown for each lot. You may set a maximum bid and allow the auto-bid feature to bid on your behalf up to that maximum. We are not liable for bids that fail to register due to internet, device or connectivity issues on your side.

4. Closing & anti-sniping

Lots close at their scheduled times, which may be staggered. If a bid is placed within a lot's final minutes, the closing time for that lot is automatically extended to allow other bidders to respond. A lot is only won once it has closed with you as the highest qualifying bidder.

5. Reserves

A lot may carry a reserve — the minimum price the seller will accept. If bidding does not meet the reserve, the lot may not be sold. Where a lot is marked as having no reserve, it sells to the highest bidder.

6. Buyer's premium & fees

A buyer's premium and/or applicable fees may be added to the hammer price. Any such premium or fee, and applicable VAT, will be shown on your invoice. By bidding you agree to pay the hammer price plus any premium, fees and VAT.

7. Payment

Payment is due in full by the cut-off time stated on your invoice. Accepted payment methods are shown on the invoice. Title to and risk in a lot pass to you only once payment has cleared in full. Lots not paid for by the cut-off may be cancelled and re-listed, and your account may be suspended.

8. Collection & risk

Lots must be collected within the period stated after payment. From the time of collection, all risk in the lot passes to you. You are responsible for the safe loading, transport and removal of items collected. Storage fees may apply to items not collected within the stated period.

9. Condition of lots (voetstoots)

All lots are sold "voetstoots" (as-is, where-is) without any warranty as to condition, fitness for a particular purpose, or merchantability, except as expressly stated. Descriptions, photographs and condition notes are provided in good faith as a guide only. You are encouraged to inspect lots and satisfy yourself as to their condition before bidding.

10. Default

If you fail to pay or collect, we reserve the right to cancel the sale, re-sell the lot, recover any shortfall and costs from you, suspend or close your account, and withhold you from future auctions.

11. Sellers

Sellers warrant that they have good title to the goods consigned and the right to sell them. Commission and any other charges are agreed with the seller before the auction. Seller proceeds are settled after the auction closes and the buyer has paid, less agreed charges.

12. Limitation of liability

To the maximum extent permitted by law, Deals4Africa is not liable for any indirect or consequential loss arising from your use of the platform or participation in an auction. Nothing in these terms limits any liability that cannot lawfully be limited.

13. Privacy

We process your personal information in line with the Protection of Personal Information Act (POPIA) and our Privacy Policy. We use your information to operate the platform, run auctions, process payments and communicate with you.

14. Governing law

These terms are governed by the laws of the Republic of South Africa, and you submit to the jurisdiction of the South African courts.

15. Changes

We may update these terms from time to time. The version published on this page at the time you bid applies to that bid.
